Entry Terms and Conditions (the “Terms”)

1. General Terms

  1. Lift 109 (“the “Attraction”), located at Battersea Power Station, London (“Site”) is owned by Battersea Chimney Lift Limited (“BPSDC” or “we”), a company incorporated at St Paul’s Gate, New Street, St Helier, JE4 8ZB, Jersey with company number 13175504 and registered at Level 5, 20 Fenchurch Street, London, United Kingdom, EC3M 3BY. For all payments made via this website, BPSDC will be the responsible contractual party. The Attraction is operated on behalf of BPSDC by International Management Group (UK) Limited (“the Operator”), a company incorporated in England and Wales with company number 00946580 and with registered office at Building 6, Chiswick Park, 566 Chiswick High Road, London W4 5HR.
  2. We set out below the Terms and Conditions (“Terms”) that shall apply to:
    1. your entry to the Attraction
    2. any purchase of Tickets (as set out below).
  3. Notwithstanding the means by which a visitor attends the Attraction, the Entry Conditions as set out below apply to all visitors attending the Attraction.
  4. The Terms relating to Tickets shall apply as set out below (save as may be varied by any Ticketing Terms and Conditions (if applicable, and as defined below).
  5. By purchasing an Attraction ticket and/or attending the Attraction using a ticket (“Ticket”), this forms a legally binding contract that is subject to, you therefore agree to be bound by: (i) these Terms; (ii) the Attraction’s Privacy Policy; and (iii) all other applicable terms and conditions. You should read these Terms carefully before you make a purchase.
  6. Admission into the Attraction is at all times subject to these Terms and the terms, conditions and rules of BPSDC. If you breach any of these Terms then we may refuse admission or require you and/or other Ticket holders to leave the Site.
  7. We respect your Personal Data and shall deal with it in accordance with our Privacy Policy and applicable UK Data Protection legislation in place from time to time. Please see our Privacy Policy for further details.

2. Entry Conditions

Attraction Tickets and Admission

8. A valid Ticket entitles the holder to visit the Attraction on the date and at the times stated on the Ticket. There shall be no admittance to the Attraction without a valid Ticket. You must retain your Ticket on your person at all times during your visit to the Attraction. You will need to purchase tickets for a specified entry time. Entry times are every 10 minutes from 10:00am until last entry at 8:00pm. Every effort to admit latecomers will be made, but admission for latecomers cannot always be guaranteed.

9. It is the Ticket holder’s responsibility to check their Ticket(s) upon receipt, as mistakes cannot always be rectified and the Operator shall not be responsible for any incorrect Tickets.

10. You may only leave and then re-enter the Attraction during your visit at the discretion of the Operator, stewards, staff and other officials. Otherwise, there shall be no re-admissions or pass-outs of any kind.

11. Tickets may not be used as prizes in competitions, “give-aways” or a lottery without the prior written consent of the Operator in its sole discretion.

12. Tickets must not be resold, exchanged, transferred, altered or defaced. Any such action shall render the Ticket(s) void (and any individual with such a Ticket may be refused entry or removed from the Attraction in the Operator’s sole discretion), without prior notification, refund, compensation or liability.

13. To prevent fraud and protect BPSDC and you, we may carry out checks and/or you may be asked to provide additional information (such as a copy of a credit or debit card statement) after your booking so we can verify your purchase. If we suspect fraud we may cancel any order or tickets.

14. Attraction Ticket prices include VAT and exclude any booking fees applied at the time of purchase.

15. It is your responsibility to check that you and your guests are permitted to attend the Attraction and have the appropriate Ticket(s). Do not buy Tickets from unlawful sources. There is no guarantee of Tickets’ validity for entry unless purchased from the official source (either online or onsite) for the Attraction. The Operator reserves the right to refuse entry to the Attraction or reject anyone from the same who is found with Tickets obtained in breach of these Terms. The Operator reserves the right to not accept and destroy any Tickets that are found to be in breach of these Terms without refund, compensation or liability.

16. All Ticket sales are final and unless otherwise stated herein, no refunds, cancellations or exchanges are available after a Ticket has been purchased other than as set out in these Terms.

17. Tickets are issued subject to the Operator’s right to alter or vary the Attraction due to circumstances beyond its reasonable control without being obliged to refund monies or exchange Tickets.

18. The Operator is not responsible or liable for any Ticket(s) that are lost or stolen, and to amend or deface any Ticket will render it void.

19. By purchasing a ticket for child, being a person who is aged 15 years old (inclusive) and under at the time of attendance at the Attraction, (a “Child Ticket”) you are confirming that you are either the parent, legal guardian or nominated guardian of the child for whom you are purchasing. Child Ticket holders can only enter the Attraction with the person who purchased their Ticket i.e., their parent, legal guardian or nominated guardian. Any Child Ticket holders attempting to enter the Attraction without this person will be denied entry to the Attraction. For safety reasons, any persons attempting to enter the Attraction with a Child Ticket holder that they are not the parent, legal guardian or nominated guardian for will be denied entry. Child Ticket holders and children under the age of 15 must be accompanied at all times by a person aged 18 years or over (a “responsible person”). The Operator reserves the right to determine the ratio of responsible persons in relation to Children required for adequate supervision.

20. Attraction Tickets shall be despatched to you electronically.

21. BPSDC will use its best endeavours to despatch Tickets to you promptly by the despatch method agreed at the time of booking, but we may (in select circumstances and where it is reasonable to do so) make pre-purchased Attraction Tickets available for collection at the Attraction box office if:
a. TBC; or
b. BPSDC is otherwise unable to despatch tickets to you electronically for any reason.

To collect tickets at the Attraction venue, the cardholder must present the card used to book the tickets as identification. Other identification or letters authorising collection may not be accepted and the tickets may be withheld at the box office.

3. Ticket Refunds and Cancellation

22. Your purchase of Tickets is subject to our right without prior notice and without refund or compensation (save as set out in clauses 17-18) to close or change the programme and/or the Attraction’s operating hours.

23. The Operator in its absolute discretion reserves the right at any time to close all or any part of the Attraction or to restrict the number of persons having access to the Attraction due to capacity, inclement weather, or special events to ensure safety, security and/or order, or if the Operator reasonably considers the circumstances so require.

24. If the Attraction (including any day or entry session) is cancelled/closed in its entirety for any reason, the Operator will use reasonable endeavours to notify Ticket holders as soon as possible (including notifying you of the details of any re-scheduled dates and operating hours the Attraction will be open). If you have already purchased a Ticket for the Attraction you will either (a) be entitled to an automatically refund or (b) reconfirm your Tickets for another date and time without incurring any extra fees.

25. You are solely responsible for any travel and accommodation arrangements to the Attraction. The Operator (or its affiliates, contractors, servants or agents) shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to travel or accommodation expenses from postponement, cancellation, abandonment or curtailment of the Attraction and you hereby waive all rights of whatsoever nature against the Operator and/or BPSDC, and each of their respective their employees, servants, agents, independent contractors or representatives arising from cancellation, abandonment or curtailment of the Attraction.

4. Attraction Security and Prohibited Items

26. To maximise safety, searches will take place at point of entry. This can include the use of metal detectors and searches of the person and bags. Please note these searches are a condition of entry, any person with illegal or prohibited items or who does not want to be searched will be refused entry and their Ticket(s) will not be refunded. Please also note prohibited items listed below. The Operator holds no liability for, and maintains the right to refuse temporary possession of, any of the below prohibited items brought onsite by you and you will not be able to enter the Attraction or receive a refund. Security checks may result in delays when entering the Attraction and/or Site, please leave extra time for these searches to take place.

27. We do not permit large bags or luggage at the Attraction for security reasons. We advise only bringing a handbag or small rucksack. We class “large bags” as anything larger than A4 size or a standard handbag. Luggage with wheels, sports equipment, folding bikes, and/or adult scooters are all prohibited. We ask all guests to be vigilant and not to leave bags and belongings unattended at any time. Any unattended item may be disposed of in line with our security protocols.

28. Prohibited Items. The following articles MUST NOT be brought into the Attraction:
a. Knives
b. Work Tools
c. Fireworks
d. Smoke canisters
e. Air-horns
f. Spray Cans
g. Chinese Lanterns
h. Handheld Communication Devices (such as radios)
i. High Visibility Clothing
j. Skateboards scooters or bikes
k. Flares
l. Weapons (or any article that might be used as a weapon and/or compromise public safety)
m. Dangerous or hazardous items
n. Laser devices
o. Bottles/ glass vessels/ cans, even if wrapped up as a present for a later time
p. Your own alcohol – even if wrapped up as a present for a later time
q. CS Gas Poles
r. Drones; selfie sticks; and/or professional filming/photography equipment
s. Open bottles of drink/liquid (unopened and sealed bottles of water will be accepted, as will empty reusable cups and bottles)
t. Illegal drugs and/or drug paraphernalia
u. Nitrous Oxide
v. Chairs/Stools
w. Banners/Flags
x. Unauthorised professional photography equipment. Equipment considered to be professional will be permitted at the discretion of the security, and
y. any other items which we consider to be unsafe or pose a risk to public safety and/or security.

29. Any person in possession of any item set out at clause 45(above) will be refused entry to the Attraction or will have such items confiscated and disposed of. Any article that might be used as a weapon, be deemed to be offensive or abusive, or compromise public safety, will be confiscated and/or reported to the police.

30. Use of illegal substances is strictly prohibited at the Attraction.

31. Visitors may be refused admission or ejected from the Attraction and the Site if, in the opinion of the Operator or BPSDC, the visitor is a risk to the safety of any patron and/or may affect the enjoyment of other patrons and/or the running of the Attraction or may cause damage, nuisance or injury. Examples include being (or appearing to be) drunk, incapable, intoxicated or under the influence of illegal drugs, under-age (where relevant), abusive, threatening, behaving anti-socially, carrying offensive weapons or illegal substances, committing a criminal offence, declining to be searched or are in breach of any of these Terms or the terms and conditions of BPSDC. The Operator reserves the right to refuse entry or evict without refund all members of any group of persons where that group is behaving in accordance with the forgoing.

32. Dogs are not permitted into the Attraction, with exception of certified assistance dogs.

33. In the event of an emergency, visitors must follow instructions and directions from stewards, staff and other officials.

34. Climbing or standing upon exhibits, tables, chairs, benches, barriers structures, parts of the building or anything similar is strictly prohibited.

5. Photography and Filming

35. Please note that CCTV and film cameras may be present within Battersea Power Station and at the Attraction. By purchasing Tickets and attending the Attraction, Ticket holders and attendees consent to being photographed, filmed and/or recorded, and consent to the image or recording of them (including any images or recordings taken by them within the Attraction) being used in distribution (commercial or otherwise) in perpetuity without any payment. All sound and moving or still picture rights including, without limitation, on the internet, vest with BPSDC (or by any third party as may be engaged by BPSDC, including but not limited to the Operator for promotional or other related purposes).

36. Photography and filming while at the Site is only allowed for the personal, non-profit making use of amateurs. Commercial or editorial photography is prohibited without prior permission from the Operator and/or BPSDC. Accreditation must be requested from the press office in advance. Amateur photography groups must also request accreditation in advance of arriving on Site.

37. A person may be denied entry to or be removed from the Attraction if he or she is found in possession of any equipment capable of taking photographs, making films, sound recordings or broadcasts; or if he or she takes any photograph, makes a film, sound recording or broadcast of anything occurring inside the Attraction for commercial gain (unless approved in accordance with clause 56).

38. A person may enter the Attraction with equipment referred to in clauses 36 and 37 above where it is integrated into electronic communications apparatus designed for personal private use (such as a mobile telephone) and/or a personal stills camera, but the person may still be removed in accordance with clause 56 above if they attempt to use this device for commercial gain.

39. Commercial, promotional and trading activities are not permitted at the Attraction without express prior written permission of the Operator. Please note that the Operator may charge a fee for any commercial activity (including filming, photography and recording as per the above) at the Attraction.

6. Alcohol

40. When in possession of a Ticket with added alcohol if you appear to be under the age of 25 you may be asked for valid identification that you are aged 18 or over. If you attend a special event, where alcohol is served you may be asked to provide proof of age on arrival at the Attraction.

41. The Operator reserves the right refuse alcohol to any attendee who, in the Operator’s or any Attraction staff’s absolute discretion, is unreasonably intoxicated and/or is behaving in an unacceptable manner.

42. Alcohol served onsite at the Attraction must be consumed onsite before leaving the Attraction. Attendees are not permitted to bring alcohol onsite from outside of the Attraction. Bag searches will be in operation.

7. General

43. You must comply with any and all instructions given to you by the Operator and/or all Attraction stewards and staff and with all Attraction and Site regulations. The Operator reserves the right to restrict access to parts of the Site.

44. Entry to the Attraction is entirely at your own risk and neither the Operator, BPDSC or their respective affiliates, contractors, servants or agents will not be liable for any distress, inconvenience or anxiety caused during the course of any ride or attraction. The Ticket holder hereby holds harmless BPSDC, the Operator and any and all entities and individuals involved in the operating of the Attraction from all liability to the Ticket holder, your personal representatives, assigns, heirs, and next of kin, for any and all loss or damage, and any claim or demands therefore on account of personal injury, death, or loss or damage to personal, private, or other property and equipment, resulting from or arising out of Ticket holder’s attendance at the Attraction.

45. Each visitor is responsible for his/her own personal property brought into the Site (including at all times while at the Attraction).

46. You agree that neither the Operator or BPSDC will not be liable for any loss, injury or damage to any person (including yourself) or property however caused (including by the Operator, BPSDC, their respective affiliates, contractors, servants or agents or any Attraction staff): (a) in any circumstances where there is no breach of a legal duty of care owed by the Operator; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from the Operator, its servants’ or agents’ negligence); or (c) to the extent that any increase in any loss or damage results from breach by you of any of the Terms.

47. Nothing in these Terms seeks to exclude the Operator or BPSDC’s liability for death or personal injury caused by their negligence, fraud or other type of liability which cannot be excluded or limited by law (including without limitation fraud or fraudulent misrepresentation).

48. To the fullest extent permissible in law, the Operator shall be entitled to assign all and any of its rights and obligations under the Terms, provided that your rights are not adversely affected.

49. If any provision of the Terms is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of the Terms valid or enforceable.

50. If the Operator delays or fails to enforce any of the Terms it shall not mean that the Operator has waived its right to do so.

51. Any person, other than BPSDC or the Operator, who is not a party to the Conditions, shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Terms.

52. The Terms do not and shall not affect your statutory rights as a consumer. For further information about your statutory rights contact Citizens Advice, Consumer Direct or the Department for Business Innovation and Skills.

53. We reserve the right from time to time to make changes to these Terms, where we consider it reasonable and necessary to do so. Where we make any such changes, we shall post the updated version of these Terms on our website. Therefore, we recommend you check these Terms regularly to stay informed of its current terms. All listings, sales and purchases are subject to the applicable version of this Terms that was published at the time of listing, sale or purchase. If you do not agree with any revised version of these Terms, or if you cannot comply with it, then you must not make a purchase.

54. The Terms constitute the entire agreement between the parties in connection to the subject matter of the Terms and supersede any previous terms and conditions, agreement or arrangement between you and the Operator relating to the subject matter of the Terms. However, nothing in the Terms shall purport to exclude liability for fraud or fraudulent misrepresentation.

55. These Terms shall be governed by English law and the parties agree to submit to the jurisdiction of the English courts in connection herewith.
